TL;DR:

The Office of Research at University of Southern California (USC) has been conducting an investigation of Hao Li’s and Pinscreen's scientific misconduct since 2018. On December 9, 2019, USC's Research Integrity Officer, Dr. Kristen Grace, confirmed in writing that Pinscreen's demo at ACM SIGGRAPH Real-Time Live (RTL) 2017, lead by Hao Li, was "misrepresented" constituting "falsification" and "research misconduct".

Subsequently, Hao Li's employment at USC has been terminated as of June 2020. When referring to the termination of his employment at USC, Hao Li has refrained from using the term "resignation" and instead has used terms such as "leaving," "separation," "ending," and "departure".

On June 5, 2020, Dr. Kristen Grace confirmed that termination of Hao Li's employment from USC was not voluntary and that Hao Li "did not resign".

Authentication:

Dr. Kristen Grace's emails were authenticated by Hao Li and Pinscreen on December 16, 2020 when their counsel, Benjamin Davidson, confirmed in a declaration submitted to the Court that the "same emails" were also produced by USC in response to a subpoena.

Hao Li and Pinscreen had previously authenticated Research Integrity Officer's emails in the communications between consels when Benjamin Davidson attempted to designate these emails as "Confidential" on the grounds that "USC's investigation of Hao Li was private."

Confidentiality:

Dr. Kristen Grace's emails have been submitted to the Court on September 21, 2020 in Exhibit A of Sadeghi's Opposition to Defendants' Demurrer to the TAC and on December 15, 2020 in Exhibit 4 of Sadeghi's Declaration in Opposition to Defendants' Ex-Parte Application.

Hao Li and Pinscreen have attempted to designate Dr. Kristen Grace's emails as "Confidential" since October 18, 2020 but failed to file the required motion to uphold the designations as outlined in Protective Order ¶7.(b).

On February 10, 2021, parties attended an Informal Discovery Conference (IDC) re the confidentiality dispute over Dr. Kristen Grace's emails but Hao Li and Pinscreen again failed to file and serve a motion to retain confidentiality within a 21 day window as required by the Protective Order ¶11.(c).

Subsequently, Dr. Kristen Grace's emails—confirming Hao Li's and Pinscreen's Public Deception at ACM SIGGRAPH RTL 2017—are de-designated pursuant to the Protective Order.
